2. About These Terms
These Terms apply to all visitors, users and customers of the Website, including consumers who purchase products through our online store.
By accessing or using the Website, or by placing an order, you confirm that you have read and understood these Terms and agree to be bound by them.
If you do not agree with these Terms, please do not use the Website or place an order.
Nothing in these Terms is intended to limit or exclude any mandatory consumer rights that apply to you under applicable law.
3. Products and Product Information
We make reasonable efforts to ensure that product descriptions, images, prices, specifications and other information on our Website are accurate and up to date.
However, colours and appearance may vary depending on your device or screen settings, and minor differences may occur between product images and the actual product.
We reserve the right to correct errors, inaccuracies or omissions and to update product information at any time without prior notice.
If a product is unavailable after you have placed an order, we will inform you as soon as reasonably possible and, where applicable, refund any amount already paid for that product.
4. Prices
All prices displayed on our Website are stated in the currency shown at checkout.
Where applicable, prices include VAT and other taxes required by law. Any additional charges, such as delivery costs or applicable customs duties, will be communicated to you before you complete your purchase, to the extent required by applicable law.
We reserve the right to change our prices at any time. A price change will not affect an order that has already been accepted by us, except where the price was clearly incorrect due to an obvious error.
5. Orders and Formation of the Contract
When you place an order through our Website, you are making an offer to purchase the products in your order.
After you place an order, you will receive an order confirmation by email. This confirmation acknowledges receipt of your order but does not necessarily mean that the order has been accepted.
A purchase agreement is formed when we accept your order, subject to applicable law.
We reserve the right to refuse or cancel an order where there is a legitimate reason to do so, including situations involving product unavailability, obvious pricing or product information errors, suspected fraudulent activity, or other circumstances permitted by law.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order or product.
6. Payment
Available payment methods will be displayed during the checkout process.
Payment must be completed using one of the payment methods offered at checkout.
We may use third-party payment service providers to process payments. Their own terms and privacy policies may also apply to the payment process.
7. Shipping and Delivery
We ship orders to the countries displayed as available during checkout.
Available delivery methods, estimated delivery times and shipping costs will be displayed during the ordering process where applicable.
Delivery times are estimates unless a specific delivery date has been expressly agreed.
If no specific delivery period has been agreed, applicable consumer law may provide a maximum delivery period. For EU consumer sales, this can generally be up to 30 days unless otherwise agreed or required by the circumstances.
If an order is delayed, we will make reasonable efforts to keep you informed.
For EU consumer purchases, the seller generally remains responsible for the goods until they are delivered to the consumer, unless the consumer independently arranged a carrier that was not offered by the seller.
For international orders outside the European Union, the customer may be responsible for applicable customs duties, import taxes, brokerage fees or other charges imposed by the destination country, unless otherwise stated at checkout.
8. Right of Withdrawal for EU Consumers
If you are a consumer located in the European Union, you generally have the legal right to withdraw from your purchase within 14 days without giving a reason.
For products, the withdrawal period normally begins on the day you, or a third party designated by you other than the carrier, receives the goods.
To exercise your right of withdrawal, you must clearly inform us of your decision before the withdrawal period expires.
You can contact us at:
Email: info@lureto-haus.com
You may use the model withdrawal form provided below, although using this form is not mandatory.
9. How to Return a Product After Withdrawal
After notifying us that you wish to withdraw from your purchase, you must send the product back to us without undue delay and, in any event, generally within 14 days of communicating your withdrawal.
Unless otherwise required by applicable law or agreed by us, you are responsible for the direct cost of returning the product when exercising the statutory right of withdrawal, provided that we informed you of this obligation before purchase.
Products should be returned in accordance with applicable law. You may handle and inspect a product to the extent necessary to establish its nature, characteristics and functioning, similar to how you would be permitted to inspect it in a physical shop. You may be responsible for diminished value resulting from handling beyond what is necessary to establish these characteristics.
10. Refunds Following Withdrawal
If you validly exercise your statutory right of withdrawal, we will reimburse the payments received from you, including the cost of standard delivery where required by applicable law.
We may withhold the reimbursement until we have received the returned goods or until you provide evidence that you have sent the goods back, whichever occurs first.
Refunds will generally be made using the same payment method that you used for the original transaction, unless otherwise agreed or required by law.
If you selected a more expensive delivery method than the least expensive standard delivery option we offered, we are generally not required to reimburse the additional cost.
11. Exceptions to the Right of Withdrawal
The statutory right of withdrawal does not apply in every situation.
Depending on the product or service concerned, exceptions may apply under applicable law. Examples can include certain personalised or made-to-order products, certain sealed goods that cannot be returned for health or hygiene reasons once unsealed, and certain digital content where performance has begun with the consumer's required consent and acknowledgement.
Where a statutory exception applies to a particular product, we will provide the relevant information before purchase.
12. Defective or Non-Conforming Products
We are responsible for ensuring that products supplied to EU consumers comply with the applicable legal requirements.
If a product is defective, does not correspond with the agreement, or does not have the characteristics that you could reasonably expect under applicable law, you may have statutory rights to a repair, replacement, price reduction or refund, depending on the circumstances.
EU consumer rules provide a minimum two-year legal guarantee for goods, subject to applicable national rules and exceptions. National law may provide consumers with additional protection.
Your statutory consumer rights are not affected by any commercial warranty or additional guarantee that we may offer.
If you believe you have received a defective or non-conforming product, please contact us at info@lureto-haus.com and provide your order number and, where appropriate, photographs or other information that helps us assess the issue.
13. Complaints
If you have a complaint about a product, your order, delivery or our service, please contact us first at:
We will make reasonable efforts to review and resolve your complaint as quickly as possible.
Nothing in our complaint procedure limits any statutory rights or remedies available to you.
14. International Orders
We may accept orders from countries outside the Netherlands and the European Union.
When ordering from outside the European Union, you are responsible for ensuring that the products you order may legally be imported into your destination country.
Additional customs duties, import taxes, handling charges or other fees may apply to international shipments. Unless expressly stated otherwise at checkout, these charges are not included in the product price or shipping price charged by us.
Customs rules and import requirements vary between countries, and we cannot guarantee that a particular product will be permitted into your country.
15. Use of the Website
You agree to use the Website only for lawful purposes and in accordance with these Terms.
You must not:
-
use the Website for fraudulent or unlawful purposes;
-
attempt to gain unauthorised access to the Website or its systems;
-
interfere with the security or operation of the Website;
-
introduce malicious software, code or other harmful material;
-
copy, reproduce or commercially exploit Website content without permission; or
-
use the Website in a way that could damage, disable or impair its operation.
We reserve the right to restrict or terminate access to the Website where reasonably necessary to protect our Website, business, customers or other users.
16. Intellectual Property
Unless otherwise stated, the content of the Website, including text, photographs, graphics, logos, designs, product descriptions, trademarks and other materials, is owned by or licensed to Aja zorg / Lureto Haus.
You may not reproduce, distribute, modify, publicly display, sell or commercially exploit our content without our prior written permission, except where permitted by applicable law.
17. Third-Party Services and Links
Our Website may use or link to third-party services, applications, payment providers, shipping providers, social media platforms or other websites.
We are not responsible for the content, availability, security or privacy practices of third-party websites or services.
Your use of third-party services may be subject to their own terms and conditions and privacy policies.
18. Privacy
We process personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR), where applicable.
For information about how we collect, use, store and protect personal data, please refer to our Privacy Policy.
19. Limitation of Liability
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
To the maximum extent permitted by applicable law, we are not responsible for indirect or consequential losses that are not reasonably foreseeable at the time the contract was concluded.
Nothing in these Terms limits your mandatory statutory consumer rights.
20. Changes to These Terms
We may update these Terms from time to time, for example to reflect changes to our business, Website, products or applicable laws.
The latest version will always be published on this page with the applicable "Last updated" date.
Changes will not affect rights or obligations that have already arisen under an order or agreement, unless required or permitted by applicable law.
21. Applicable Law
These Terms are governed by the laws of the Netherlands, except where mandatory consumer protection laws in your country of residence provide you with additional rights that cannot legally be excluded.
If you are a consumer residing in another EU country, the choice of Dutch law will not deprive you of the protection provided by mandatory provisions of the law applicable to you.
22. Disputes
We encourage customers to contact us first so that we can attempt to resolve any complaint or dispute directly.
Where a dispute cannot be resolved directly, consumers may have access to alternative dispute resolution procedures or other dispute-resolution mechanisms available under applicable law.
Consumers in the European Union may also have rights concerning the courts of their country of residence, depending on the applicable rules.
23. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or modified to the extent necessary to make it enforceable, where legally possible.
The remaining provisions will continue to apply.
